When a DUI involves an accident or property damage there are several factors to be considered in addition to the basic DUI defense.
Tickets
After an accident there may be several traffic citations issued. If all of the citations are paid before the person charged speaks with an attorney, their driver’s license may be suspended for accumulating too many points.
When you hire experienced attorneys such as those of Finebloom and Haenel, we can help you with the additional tickets. We can fight them, merge them with your DUI case, or advise you of the proper way to pay them so as to minimize the impact on your license.
Restitution
In addition to the regular DUI penalties a court may require restitution to be paid. Restitution is money paid to the person whose property was damaged. Sometimes the State, on behalf of the complaining witness, will ask for too much restitution. For example, sometimes a person will ask for money for car repairs already covered by insurance. Without proper representation, you may end up paying money you do not have for bills you do not owe.
Our experienced attorneys on staff will question the amount of restitution the State claims you owe. If the attorney is unable to negotiate an agreed upon amount on your behalf, we will request a restitution hearing to demand the State show proof of the amounts they request. At Finebloom and Haenel we are committed to protecting all of your rights associated with your DUI arrest.
Physical Injury
If a person was seriously injured in an accident connected with your DUI arrest, it is possible for you to be charged with a felony offense. If the injuries were minor, the case will remain a misdemeanor. The attorneys at Finebloom and Haenel are familiar with the criteria needed to categorize the injury as a serious one. If there were injuries alleged in your DUI accident, they are able to fight to make sure you are not overcharged. If you are charged with a felony, they are qualified to represent you in this very serious matter.
