If you have been arrested in Hillsborough County for DUI and have 2 prior convictions for DUI anywhere in the United States, you will be facing enhanced penalties. If your Hillsborough County DUI arrest is the third time you’ve been arrested for DUI, and your most recent DUI conviction was more than 10 years ago, your third time DUI in Hillsborough County will be charged as a misdemeanor. If you are convicted of a third time DUI in Hillsborough County and your last DUI conviction was more than 10 years ago, you could be facing a maximum of 11 months and 29 days in the Hillsborough County Jail and/or probation through the Salvation Army Correction Services. As a condition of your Hillsborough County DUI probation, you will be required to pay a minimum fine of $2,000.00 with a maximum fine of $5,000.00. If you provided a breath test that is a .15 or higher, the minimum fine you will be required to pay is $4,000.00. The court will revoke your driver’s license for a minimum of 6 months with a maximum of 12 months, require a 10 day immobilization of your vehicle and require the installation of an ignition interlock device in your vehicle for a period of 2 years. The court may also require you to attend a Victim Impact Panel sponsored by Mothers Against Drunk Driving and perform community service hours.
